So you're actual question is simply, is it illegal to have an affair?

 

Several states (my current home state, errr, Commonwealth, Virginia included) have laws against it. All of them are horrendously unconstitutional.

 

Still obvious grounds for divorce and all that entails.

I'm thinking in a more legalistic way. HR departments don't write laws.

The legal terms are Adultery (having sexual relations outside of one's marriage) and (having sexual relations outside of any marriage at all).

That's a civil issue. Mostly to be argued about by horrible people with more money than sense.

Exactly.  Every single person involved in that case was a scumbag.  I wish there was a decision that would have made both people lose money.  Maybe it could have gone to us jurors who had to listen to that crap.
