Sabel79 Posted May 15, 2018 Report Posted May 15, 2018 Is having an affair "sexual misconduct"? So you're actual question is simply, is it illegal to have an affair? Several states (my current home state, errr, Commonwealth, Virginia included) have laws against it. All of them are horrendously unconstitutional. Still obvious grounds for divorce and all that entails. Quote

shrader Posted May 15, 2018 Report Posted May 15, 2018 I'm thinking in a more legalistic way. HR departments don't write laws. Is "sexual misconduct" even a legal term? It seems like way to broad of a term to have a specific charge attached to it. Quote

The legal terms are Adultery (having sexual relations outside of one's marriage) and (having sexual relations outside of any marriage at all). Seriously? Forn I cation gets filtered? Quote

And then in rare states, the classic "alienation of affection". I had to serve on a jury for one of those two years ago. What an absolute clown show that one was. Quote

Every single person involved in that case was a scumbag. I wish there was a decision that would have made both people lose money. Maybe it could have gone to us jurors who had to listen to that crap.
