Assault is a legal term, and legally he did not assault anyone. No intent also not known if there is an actual injury/ mark/ bruise on Crosby, also required for assault. Assault requires mens rea, not a strict liability crime (like manslaughter for example). Â A penalty yes, game misconduct is a stretch. Assault no. Quote

The Caps player's eyes are fixed elsewhere, on the puck most likely. He was just reacting to Crosby hurtling into him.
