papazoid Posted July 6, 2011 Report Posted July 6, 2011 Barnaby, 38, was accused of causing an estimated $300 in damage by kicking the garage door May 13 in an attempt to enter the suburban Buffalo home where his wife and two children live, Erie County district attorney Frank Sedita's office said. He had pleaded not guilty to five charges. As part of her ruling, Buffalo State Supreme Court Justice Deborah Haendiges also issued a one-year order of protection, barring Barnaby from having contact with his wife and her boyfriend, the DA's office said. Unless the garage door came crashing down and ruined whatever vehicle/s was/were parked in the general vicinity, that's absurd. And maybe I'm just not familiar enough with his past history to know that this is a repeat offense, but still ... I mean hell, I've kicked my car carport shed door when I've accidentally cut myself on the latch. Do *I* need anger management classes as well? Should I be court-ordered to stay away from my family because, in a brief fit of momentary anger, I kicked a helplessly inanimate object? Kind of ridiculous, in my book. He didn't strike his ex-, he didn't hurt his kids. And I'm betting he didn't do much--if any--damage to the garage door.

I would hope so ... I just looked up Utah law as to what constitutes "Domestic Violence." Link. Assuming that what's in the article is ALL that happened, it doesn't even begin to come close to 'domestic violence.' However, I can see some pissed off ex-wife calling the cops and claiming to feel threatened and endangered. Then again, like you said, there's probably more to the story than we're getting, which then makes the whole article sloppy journalism. Figures.

As long as he does what the judge told him to do and completes his community service in the next six months he is done with no conviction and the case is sealed. He would have gladly performed 1,000 hrs of community service for this resolution. An ACD in a domestic violence case including a felony (probably felony criminal mischief, damage >$250.00) is a huge win.

This wasn't lost on me, but not voluntarily... even the local sports radio stations have been discussing this "zoo" of a trial. I've never wanted to kill an event with fire so badly in my life, and I've been to a 10yo and under girl's softball game.
