Props to this guy for going after a small-market sports team for no good reason. Even though I can't say I have much love for the Sabres' front office, they shouldn't have to pony up cash for this. Seriously, if this junk lawsuit goes through, we should definitely take up a collection for the Sabres. It might go to charity like Ruff?s collection last year, but at least the professor knows where the rest of the Buffalo area stands.

In fact, even signing one of those waiver forms that say "I realize _____ is dangerous and agree not to hold _____ liable ..." does little to protect the company from a lawsuit. I am not an attorney, but I believe he would have to demonstrate that the Sabres knew it was likely that they glass would come out and did not take appropriate steps to prevent it.

Did anyone actually get hurt or is he just doing this because he can? no mention of that, you're right -- but that was, after all, wkbw reporting -- they're just a few notches above the newscast of a community college's media production class. i wouldn't be surprised if there were some injuries -- cuts, bruises at a minimum. still, i'd also be stunned if management failed do what they could to make-nice with this guy, i.e., pay any reasonable medical bills, lost wages, etc. and offer another set of tickets of their choosing and a good number of "sabres bucks". if management did fail to act in that way, i'd be disappointed. in any event, this just confirms beyond any doubt that bruce jackson's a tool.

I'll come out of the bushes as an attorney. :ph34r: As a general matter, it's correct to say that those waiver statements on tickets (which, in real property law terms, I believe, are "revocable licenses" to use that seat (e.g, drunk a-holes know all about the "revocable" part)), and those standard releases that people sign at places of "public amusement" (ski slopes, bouncehouses, horse trails) are hardly worth the paper they're written on. I don't think the governing laws will require Jackson to show that the Sabres knew (or should have known) it was "likely" that the glass would pop -- more likely, the legal theory will be that the team failed to properly install, monitor, maintain, etc. the stanchions at issue. Hell, there's probably a claim against the company that made the stanchions and the glass. Tool.

Although it should be thrown out long before it ever gets to court. I'll bet you his lawyer contacted him and has been chirping in his ear... it sounds strange but that happens a lot. check this story out... My uncle went to a game in the early 80's against the Canucks, when they had those black V uniforms, long before the "protective netting"... anyway, someone took a shot and it deflected into the stands and my uncle lost sight of it in the black uniforms... it came up and hit him in the chest, he was stunned but overall fine. A few minutes later a lawyer came running down to him and told him to fall over, my uncle was like "WHAT?!". the lawyer said "fall over, we can sue them"... my uncle told him to take a hike... so it doesn't surprise me that this guy is suing someone, sad but true

They didn't take the proper steps to make sure it was installed correctly, wasn't deteriorating with time, etc. to prevent a possible/likely failure. I will leave any other legal interpretations to you.

Which is exactly why I mentioned that the report was so short. You think they'd actually want to put an important detail like that in the story. But anyway, cuts and bruises would be too funny. He can go after the team for medical expenses. Hell, I'll personally pay for the band-aid and ice pack.

"Pseudo-intellectual"? I wouldn't say that, but it is quite a commentary about today's society that someone who has a PhD who obviously knows better would sue over something this stupid. That is the utterly disgusting thing here, and he is an embarassment to the university or college that he represents. Be careful, or this misguided twit might venture over here, read what is said about him, and sue us for libel. Please professor, bring that heat... I'd love to have the opportunity in open court to tell everyone and the media how ignorant you are! :)

Just another frivilous lawsuit to make some quick $$$ because he can But you are making it sound like this would bankrupt the team if he was awarded any money, or that this could keep the team from being able to pay Miller or Pomminstein. As for a collection, i think the team has taken enough of our money this year, and this shouldn't be a problem for them IF (and thats a big if) this guy walks away with any money
